Terms of Service

These Terms of Service (“Terms”) govern your access to and use of www.dominiclevien.com, including any courses, masterclasses, downloadable content, and live events offered through this site (collectively, “the Services”) provided by Dominic Levien (“we”, “us”, “our”, “me”, “my”).

By using the Services, signing up for the newsletter, registering for a masterclass, or enrolling in a course, you agree to these Terms. If you don’t agree, please don’t use the Services.


1. Who we are


2. Eligibility

You must be at least 18 years old to purchase a course or masterclass. The Services are intended for adults. By purchasing, you confirm you are 18 or older.

If you are between 16 and 17 years old, you may use the Services only with the consent and supervision of a parent or legal guardian.


3. Account creation

To enrol in a course or attend a masterclass, you create an account using a valid email address and password. You are responsible for keeping your login credentials secure. Don’t share your account with others — each account is for one individual.

If you suspect unauthorized access to your account, notify us at hello@dominiclevien.com immediately.


4. What you’re buying

When you enrol in a course or masterclass, you receive a personal, non-transferable license to access the content of that course for the duration described on the sales page. This includes:

  • Access to videos, audio recordings, and downloadable PDFs
  • Participation in any live elements specifically included in your purchase tier (e.g. live online calls, private group chat for live cohort tiers)
  • Customer support via email for course-related questions

You do not receive ownership of the content or the right to redistribute, resell, share, or republish any of it. See section 8 for full intellectual property terms.


5. Pricing, payment, and taxes

All prices are listed in Euros (EUR) and are inclusive of any applicable Spanish taxes unless otherwise stated. Prices may change at any time, but changes do not affect courses you have already purchased.

Payment is processed by Stripe. By purchasing, you authorise Stripe to charge the payment method you provide for the amount shown.

6. Refund policy

I want anyone who buys from me to feel safe stepping in. The refund policy is generous — it asks only that you give the work an honest try.

Online courses (live cohorts, alumni repeat, masterclass, self-paced)

This applies to everything delivered online — the live cohort, the alumni repeat tier, the masterclass, and the self-paced version.

For courses without granular completion tracking (e.g. the masterclass), the 25% threshold is treated as 2 weeks from purchase.

For the 100%-complete refund path: I’ll send you a feedback questionnaire and ask for evidence that you genuinely practised (e.g. completed habit tracker, daily practice log, Control Pause measurements where applicable). If you put in the work and it didn’t land, I want to make it right.

Retreats

Different policy because of fixed venue costs and capacity reservations:

  • 100% refund if you cancel 4 or more weeks before the retreat start date.
  • 50% refund if you cancel 2 to 4 weeks before the retreat start date.
  • No refund within 2 weeks of the retreat start, or once the retreat has begun.

Exceptional circumstances

If you experience a medical emergency or genuine extraordinary circumstance that prevents your participation in any product, contact me at hello@dominiclevien.com and we will discuss in good faith outside the standard policy.

How to request a refund

Email hello@dominiclevien.com with:

  • Your order number
  • “Refund request” in the subject line
  • Brief reason (helps me improve future iterations; not required for under-25% requests)

For 100%-completion refund requests on online courses, I’ll send the questionnaire and ask for evidence of practice. Refunds are processed within 14 business days of approval, via your original payment method.


7. Live cohort specifics

If you purchase a live cohort tier, the following additional terms apply:

  • Live calls are scheduled at the times published on the sales page for that cohort. Recordings may be made available to cohort members for catch-up; if you don’t want to be recorded, please notify me before the call.
  • Private group chat access (the platform — e.g. WhatsApp, Telegram, or another channel — is published with the cohort) is provided as part of the cohort experience. Conversations within the group are confidential to that cohort. Do not screenshot, share, or republish other members’ messages outside the group.
  • Cohort timing is fixed — if you miss a live call, you can review the recording (where available), but live calls cannot be rescheduled to your individual availability.

8. Intellectual property

All content on this site and within the courses — including videos, audio recordings, written materials (PDFs, manuals, worksheets), graphics, course structure, methodology, and the brand “Breathe with Dominic” — is the intellectual property of Dominic Levien and is protected by copyright and trademark laws.

You receive a personal, non-transferable, non-exclusive license to access the content for your own personal use. You may not:

  • Download, copy, or screen-record videos for redistribution
  • Share login credentials with others
  • Reproduce or republish any course material on your own site, social media, or in your own teaching
  • Use any course material as part of your own commercial offering
  • Translate, adapt, or create derivative works

Brief, attributed quoting (e.g. in a personal blog post, social media reflection) is welcome. When in doubt, ask.


9. Acceptable use

When using the Services, you agree not to:

  • Disrupt or interfere with other users (e.g. in the private group chat, on the live calls, or in lesson comments)
  • Attempt to gain unauthorized access to other users’ accounts or to the site’s systems
  • Use the Services for any illegal purpose
  • Submit false personal information

I reserve the right to suspend or revoke access for users who violate these terms, without refund.


10. Health and safety — breathwork content

Our courses include breathwork practices, breath-holding exercises, hypoventilation training, and related body-based techniques. These are educational practices, not medical treatment.

By enrolling in any course, you acknowledge and agree:

  • You are responsible for your own physical and mental wellbeing while practising.
  • The practices are intended for healthy adults. You should not participate, or should consult a qualified medical professional first, if you have any of the following: cardiovascular conditions (including hypertension, heart disease, or recent heart events), respiratory conditions (asthma, COPD, recent infections), epilepsy or a history of seizures, pregnancy, severe mental health conditions (including but not limited to active psychosis, severe PTSD, suicidal ideation), recent surgery, or any condition where altered breathing or breath-holding could pose a risk.
  • Practices like Control Pause holds, Intermittent Hypoxic Training, and extended breathing patterns can cause dizziness, lightheadedness, or, in rare cases, loss of consciousness. Practise only in a safe environment (sitting or lying down, never while driving, swimming, or operating machinery).
  • If you experience pain, severe discomfort, dizziness beyond brief lightheadedness, or anything alarming, stop immediately and consult a medical professional if needed.
  • The content of the courses is not a substitute for medical, psychological, or psychiatric care. Do not begin, alter, or stop any treatment based on course content.

You participate at your own risk and accept full responsibility for your own physical and mental wellbeing.


11. Disclaimer of warranties

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.

I do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. Reasonable efforts are made to maintain uptime and content quality, but no guarantee is made.


12. Limitation of liability

To the maximum extent permitted by law, Dominic Levien shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Services, including but not limited to loss of profits, data, or other intangible losses.

In any event, total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid for the specific course or masterclass giving rise to the claim, in the 12 months preceding the claim.

This limitation does not apply to liability that cannot be excluded by Spanish or EU consumer law (e.g. liability for personal injury caused by negligence, or for fraud).


13. Indemnification

You agree to indemnify and hold harmless Dominic Levien from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any third-party rights.


14. Termination

Either party may terminate this agreement at any time:

  • You can stop using the Services at any time. If you wish to delete your account, email hello@dominiclevien.com.
  • I may suspend or terminate your access if you violate these Terms, with or without notice depending on severity.

Upon termination for cause (your breach), no refund is owed for the unused portion of any course.


15. Modification of these Terms

I may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. Significant changes will be communicated via email to active subscribers and prominently displayed on the site.

Your continued use of the Services after a change constitutes acceptance of the updated Terms.


16. Governing law and disputes

These Terms are governed by the laws of Spain, without regard to its conflict-of-laws principles. EU consumer protection law also applies where you are an EU consumer.

For any dispute arising out of or relating to these Terms or the Services, you and I agree to first attempt to resolve the matter informally by contacting hello@dominiclevien.com. If informal resolution fails, EU consumers may use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

If formal legal action is required, the courts of Spain shall have jurisdiction, subject to mandatory consumer protection rules in your country of residence.


17. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.


18. Entire agreement

These Terms, together with the Privacy Policy and any course-specific terms shown on a sales page at the time of purchase, constitute the entire agreement between you and Dominic Levien regarding the Services. They supersede any prior agreements or representations.
